Terms and conditions
Last updated: October 18, 2026
1. Scope and who provides the service
These terms govern the use of the www.helmac.ca site and the purchase of HBS, a cloud business management software.
The site is operated by Helmac Business Solutions Inc. (Canada). In Colombia, the HBS service is provided and invoiced by Luis Javier Rodriguez Restrepo, an individual doing business as Compuhelmac Soluciones Tecnológicas (the "Provider"). In all other countries it is provided by Helmac Business Solutions Inc.
By signing up, using the site or purchasing the service, the Customer accepts these terms.
2. The service
Depending on the plan, HBS includes sales, point of sale, inventory, purchasing, treasury, accounting, payroll, hotel and restaurant. The Customer signs in with a username and password and is responsible for what the users it creates do.
On-premises installations are also governed by the end-user license agreement (EULA) delivered with each installation.
3. Plans, prices and free trial (Colombia)
Current plans and prices, in Colombian pesos, are published at www.helmac.ca/pricing. The price depends on the plan, the size of the company and the add-ons (extra users and registers, payroll employees).
Prices are final: the Provider is not registered for VAT and does not charge it.
Every new account starts with a 14-day free trial. The first charge is made when the trial ends (or when any extra days granted by a coupon end).
4. Billing and renewal
Payment is in advance, monthly or yearly (the annual plan charges 10 months for 12). The subscription renews automatically at the end of each period and is charged to the saved payment method (card or Nequi); each invoice can also be paid with PSE.
Payments are processed by Wompi. The Provider never receives or stores full card details.
If a charge fails, it is retried the next day, after three days and after seven days, with an email each time. If it is still pending after ten days, the account becomes read-only: the Customer can view and export all its information but cannot record anything new. Nothing is deleted, and once paid the account goes back to normal.
5. Plan changes and size based on sales
Upgrading applies immediately and only the difference for the remaining days of the period is charged. Downgrading or changing the billing interval applies at the next renewal.
The size of the company is determined by its monthly sales before tax, which HBS measures every month. If the last two months exceed the cap of the contracted size, an email is sent and the next period is charged at the corresponding size. If sales go down, an email is also sent and the Customer decides whether to change.
6. AI credits and coupons
Each plan includes monthly credits for the assistant and AI document reading; they renew every month and do not carry over. Additional packs last 12 months from purchase and are neither refundable nor transferable. If the company sets up its own Anthropic key, AI is billed to that account and does not use credits.
Coupons apply under their own conditions (validity, plans, number of uses), one per subscription, and cannot be exchanged for cash.
7. Cancellation
The Customer can cancel at any time from the Subscription tab. The service continues until the end of the paid period and then does not renew. There are no refunds for partial periods, without prejudice to the rights Colombian law grants consumers (Law 1480 of 2011).
Cancelling does not delete the information: the Customer can export it, and if it requests deletion it is deleted, except what the law requires to be kept.
8. Changes to prices and to these terms
If prices change, notice is given by email at least 30 days in advance and the new price applies from the first renewal after the notice. Changes to these terms are published on this page; those that affect the subscription are also announced by email.
9. Customer information
The information the Customer records in HBS belongs to the Customer. The Provider processes it only as a processor, to provide the service, under the Privacy policy and Colombian Law 1581 of 2012.
10. Intellectual property
The website, its content, trademarks, logos, designs and the HBS software are the exclusive property of Helmac or its licensors. Copying, redistribution or use without written authorization is prohibited.
11. Acceptable use
The site and services may not be used for illegal activities, attempts to breach security, automated mass scraping or distribution of malicious content.
12. Availability and liability
The Provider makes reasonable efforts to keep the service available and backed up, but does not guarantee uninterrupted operation. Except in cases of wilful misconduct or gross negligence, its total liability to the Customer is limited to what the Customer paid in the three months before the event giving rise to it.
Liability for on-premises installations is governed by the applicable EULA.
13. Third-party links
The site may contain links to third-party services. Helmac does not control those sites and is not responsible for their content or policies.
14. Governing law and jurisdiction
The HBS service in Colombia is governed by the laws of the Republic of Colombia; disputes will be resolved by the competent courts of Colombia, without prejudice to the authority of the Superintendence of Industry and Commerce on consumer protection.
Use of the site and the services Helmac Business Solutions Inc. provides outside Colombia are governed by the laws of Canada.
